The particular providers may change from time to time.

4. Important medical education and regulatory disclaimer

4.1 Independent educational service

img.coach is an independent educational and coaching service primarily intended to assist International Medical Graduates and other medical professionals preparing for aspects of Australian medical examinations, assessment processes, professional practice and registration pathways.

img.coach is not a government authority, registration authority, accreditation body, university or specialist medical college.

Unless expressly stated otherwise, img.coach and Albirway Pty Ltd are not affiliated with, endorsed by, sponsored by, authorised by or acting on behalf of:

  • (a) the Australian Health Practitioner Regulation Agency (AHPRA);
  • (b) the Medical Board of Australia (MBA);
  • (c) the Australian Medical Council (AMC);
  • (d) the Royal Australian College of General Practitioners (RACGP);
  • (e) the Australian College of Rural and Remote Medicine (ACRRM); or
  • (f) any other government, registration, examination, accreditation or professional body.

References to those organisations are made only where reasonably necessary to describe or discuss relevant pathways, standards, examinations or processes.

4.2 Educational purposes only

The Services are provided for educational, coaching and professional-development purposes.

Unless expressly stated otherwise for a particular accredited activity, participation does not constitute:

  • (a) formal medical training;
  • (b) an Australian medical qualification;
  • (c) accredited specialist training;
  • (d) supervised clinical practice;
  • (e) an internship or residency;
  • (f) recognised professional accreditation or certification; or
  • (g) any qualification or credential necessary to practise medicine in Australia.

4.3 Qualifications of coaches

Services may be delivered by people with different professional backgrounds and experience.

Depending upon the Service, a coach or educator may be an Australian medical graduate, International Medical Graduate, medical practitioner registered in Australia, person experienced in an Australian registration pathway, educator, coach or support team member.

Not every img.coach coach, educator or support person is necessarily a registered medical practitioner.

Where a person's registration status or professional qualification is material to a Service, participants should rely only upon the description expressly provided for that Service or individual.

4.4 Not medical advice

The Services do not constitute patient-specific medical or clinical advice.

Educational discussions, model answers, scenarios and feedback do not replace professional clinical judgment, applicable clinical guidelines, workplace policies, professional supervision or legal and regulatory obligations.

Nothing in the Services creates a doctor-patient relationship between a participant and img.coach, Albirway Pty Ltd, a coach or another participant.

4.5 Not legal, migration or regulatory advice

Information about AHPRA, MBA, AMC, PESCI, RACGP, ACRRM, registration pathways, examinations, accreditation or similar matters is general educational information.

It does not constitute legal advice, migration advice or professional regulatory advice.

Requirements and procedures may change. You are responsible for checking current requirements with the relevant official authority and obtaining appropriate professional advice where necessary.

4.6 No guarantee

We do not guarantee that participation in a Service will result in:

  • (a) passing an AMC or other examination;
  • (b) passing or obtaining a favourable PESCI outcome;
  • (c) registration with AHPRA or the Medical Board of Australia;
  • (d) obtaining limited, provisional, general, specialist or any other category of registration;
  • (e) satisfying an AMC, RACGP, ACRRM or other professional requirement;
  • (f) employment or an employment interview;
  • (g) obtaining supervision, placement or a training position;
  • (h) obtaining a visa or right to work in Australia;
  • (i) accreditation or recognition of qualifications; or
  • (j) any other examination, registration, professional or employment outcome.

Results depend upon numerous matters outside our control, including your knowledge, preparation, experience, performance and individual circumstances and decisions made by independent authorities or organisations.

4.7 Mock assessments

Any mock examination, simulated PESCI, mock interview, scoring, suggested answer, performance assessment or feedback provided by img.coach is an educational simulation.

It is not an official assessment and does not predict or guarantee the result of an actual examination, interview, PESCI or registration process.

5. Patient information and confidentiality

5.1 No identifiable patient information

You must not provide, upload, display or disclose identifiable patient information through the Services.

Clinical cases discussed during coaching must be appropriately anonymised or de-identified.

5.2 Participant responsibility

You remain responsible for complying with all professional, ethical, confidentiality, privacy, employment and regulatory obligations applying to information obtained through your work or training.

If we reasonably believe that material contains identifiable patient information, we may remove the material and require you to cease discussing it.

6. Bookings and attendance

6.1 Bookings

Bookings may be made through the Website or a third-party booking platform nominated by us.

A booking is not confirmed until any required payment has been successfully processed and you receive confirmation.

6.2 Attendance

You are responsible for attending at the scheduled time and ensuring that you have appropriate internet access, equipment and software.

If you arrive late, a session may still finish at its originally scheduled time.

6.3 One free reschedule

Unless different conditions were clearly disclosed before purchase, an individual booked session may be rescheduled once without charge if you give us at least 48 hours' notice before its scheduled commencement.

Further rescheduling may be refused or subject to an administrative charge disclosed to you before the change is made.

6.4 Cancellation within 48 hours

Subject always to your rights under the Australian Consumer Law, a participant who cancels or requests a reschedule less than 48 hours before a scheduled session because of a change of mind is not ordinarily entitled to a refund or replacement session.

6.5 Non-attendance

Subject to applicable law, failure to attend a scheduled session without appropriate notice will ordinarily result in the session being treated as provided and no change-of-mind refund or replacement session being available.

6.6 Compassionate and exceptional circumstances

We recognise that genuine medical emergencies, serious illness, bereavement and other significant unforeseen circumstances may prevent attendance.

You may request special consideration by contacting office@img.coach as soon as reasonably practicable and explaining the circumstances.

We may request reasonable supporting information where appropriate.

Depending upon the circumstances, we may offer a rescheduled session, credit, transfer to another cohort or another reasonable arrangement.

Nothing in this clause restricts any right or remedy available under the Australian Consumer Law.

7. Courses and cohorts

7.1 Course commencement

Course and cohort commencement dates and inclusions will be communicated before enrolment.

7.2 Transfer requests

After a cohort or fixed-term course has commenced, transfers are not automatically available for change-of-mind reasons.

We may permit a transfer to a later cohort in genuine medical, compassionate or other significant unforeseen circumstances.

Requests must be made to office@img.coach.

Any decision under this clause does not limit a statutory right or remedy.

7.3 Access period

Digital materials may be available only for the access period stated at the time of purchase.

Access may expire automatically at the end of that period.

8. Recording of sessions

8.1 Our recordings

We may record certain group sessions for educational, quality-assurance, training, course-access or internal purposes.

Where a group session is to be recorded, we will provide notice and obtain any consent required by applicable law before recording.

We do not ordinarily record one-to-one coaching sessions.

Our handling of recordings is governed by our Privacy Policy.

8.2 Participant recording strictly prohibited

Participants must not photograph, screenshot, screen-record, audio-record, video-record, transcribe using automated tools, livestream, copy or otherwise capture any session, whether a group or one-to-one session, without our prior written permission and any consent required from other persons involved.

This is a contractual prohibition and applies irrespective of whether a particular form of recording might otherwise be permitted by law.

8.3 Serious breach

Unauthorised recording or distribution of a session is considered a serious breach of these Terms and the Code of Conduct.

We may suspend or terminate access to the Services where we reasonably consider that such a breach has occurred.

We also reserve the right to seek available legal remedies where unauthorised recording, publication, disclosure or distribution infringes our rights or the rights of another person.

9. Fees, GST and payment

9.1 Prices

Unless otherwise stated, prices displayed to Australian consumers are in Australian dollars (AUD) and inclusive of GST where GST applies.

9.2 Payment providers

Payments may be processed by third-party providers including PayPal, Revolut and/or another payment provider identified at checkout.

Payment processing may also be subject to the payment provider's terms and privacy policies.

Where required, you authorise us and the applicable payment provider to process the transaction.

We do not ordinarily receive or retain complete payment-card details where payment is processed directly by a payment provider.

9.3 Receipts

We will provide or make available an appropriate receipt, proof of purchase or tax invoice as required by law.

9.4 One-off payments

Some Services require a single upfront payment.

9.5 Recurring subscriptions

Where a Service is sold as a recurring subscription, the price, billing frequency, duration or renewal basis and applicable cancellation arrangements will be disclosed before you subscribe.

By purchasing a recurring subscription, you authorise the applicable payment provider to process recurring payments according to the terms disclosed at checkout.

You may cancel future subscription payments in accordance with the cancellation mechanism provided for the subscription and any applicable payment-provider requirements.

Cancellation does not retrospectively cancel Services already supplied or charges properly incurred before cancellation.

9.6 Fixed-term programs paid by instalments

Some Services may be sold as a fixed-term program with the price payable by instalments, including weekly instalments.

Where clearly described as such before purchase, an instalment arrangement is a method of paying the agreed price of the fixed-term Service and is not necessarily a week-to-week subscription that may be terminated merely by cancelling the payment authority.

The total or determinable price, duration, instalment amount and frequency will be disclosed before purchase.

Cancelling a payment method does not, by itself, extinguish an amount otherwise lawfully owing under a fixed-term agreement.

This clause operates subject to the Australian Consumer Law and any other applicable law.

9.7 Failed payments

If a scheduled payment fails, we may notify you and request another payment method.

Subject to applicable law and the terms disclosed for the Service, we may suspend access while amounts properly due remain unpaid.

10. Refunds and Australian Consumer Law

10.1 Change of mind

Except where expressly stated in these Terms, a separate Refund Policy or the conditions of a particular Service, we are not required to provide a refund merely because you change your mind.

10.2 Consumer guarantees

Our Services come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right or remedy that cannot lawfully be excluded, restricted or modified.

Where the Australian Consumer Law gives you a right to a refund, cancellation, re-performance, compensation or other remedy, that statutory right applies notwithstanding any change-of-mind cancellation provision in these Terms.

10.3 Refund method

Approved refunds will ordinarily be returned through the original payment method where reasonably practicable.

11. Accounts and access

Where account functionality is available, you must:

  • (a) provide accurate information;
  • (b) maintain the confidentiality of your login credentials;
  • (c) not share your account with another person;
  • (d) notify us promptly of suspected unauthorised access; and
  • (e) use your account only for lawful personal use connected with the Services.

Access is personal and non-transferable unless we agree otherwise in writing.

12. Intellectual property

12.1 Ownership

All intellectual property rights in materials created or owned by us in connection with the Website and Services remain owned by or licensed to Albirway Pty Ltd.

This includes course materials, videos, recordings, slides, frameworks, templates, questions, educational scenarios, diagrams, written materials, branding and other resources.

12.2 Limited licence

Upon payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use course materials for your own private educational purposes during the applicable access period.

12.3 Prohibited conduct

Without our prior written consent, you must not reproduce, publish, distribute, upload, sell, licence, commercially exploit, publicly display, modify or provide our materials to another person.

You must not share account credentials or enable another person to obtain unauthorised access to paid content.

13. Artificial intelligence

We may use artificial intelligence or automated technologies to assist with aspects of the Services, including educational feedback, administration, transcription, content support or analysis.

Where personal information is processed using such technology, we will handle that information in accordance with our Privacy Policy and applicable law.

AI-generated or AI-assisted material may contain errors and must not be treated as authoritative medical, clinical, legal or regulatory advice.

You must not enter identifiable patient information or other information that you are not authorised to disclose into an AI-enabled feature provided through the Services.

14. Third-party services

We may use third-party providers for booking, payments, videoconferencing, email, website hosting, analytics, artificial intelligence, learning management and related functions.

Your use of a third-party service may be subject to that provider's own terms and privacy policy.

We are not responsible for an independent third party's acts or omissions except to the extent liability cannot lawfully be excluded.

15. Code of Conduct

You must comply with the img.coach Code of Conduct.

Serious or repeated breaches may result in warnings, removal from a session, suspension or termination of access.

Where reasonably practicable and appropriate, we will consider the seriousness of the conduct and surrounding circumstances before terminating access.

Immediate action may be taken where reasonably necessary to protect participants, staff, confidential information, intellectual property, system security or the integrity of the Services.

16. Testimonials and marketing

We will not rely merely upon acceptance of these general Terms as permission to use your identifiable image, video, recording or testimonial in public advertising.

Where we wish to use identifiable participant material for marketing or promotional purposes, we will seek separate permission or consent as appropriate.

17. Service changes and availability

We may make reasonable changes to scheduling, coaches, delivery platforms or administrative arrangements.

If we make a significant change to a paid Service that materially reduces what you purchased, we will provide an appropriate remedy where required by the Australian Consumer Law.

We may reschedule a session because of illness, emergency, technical failure or another reasonable operational circumstance.

Where we cancel a session, we will ordinarily offer a replacement session, rescheduling, credit or refund as appropriate and as required by law.

18. Suspension and termination

18.1 By us

We may suspend or terminate access where we reasonably believe that you have:

  • (a) materially or repeatedly breached these Terms or the Code of Conduct;
  • (b) made an unauthorised recording;
  • (c) unlawfully or improperly distributed our intellectual property;
  • (d) threatened, harassed or seriously disrupted another participant or staff member;
  • (e) compromised another person's privacy or confidentiality;
  • (f) shared account access;
  • (g) engaged in fraudulent or unlawful conduct; or
  • (h) created a material safety, security or legal risk.

18.2 Consequences

Termination for your serious breach does not automatically entitle you to a refund for Services already properly supplied.

Any entitlement concerning Services not yet supplied will be determined having regard to the circumstances, these Terms and applicable law.

18.3 Accrued rights

Termination does not affect rights and obligations that accrued before termination or provisions intended by their nature to continue, including confidentiality and intellectual property obligations.

19. Liability

19.1 Non-excludable rights

Nothing in these Terms excludes liability or rights to the extent that exclusion would be unlawful.

19.2 Matters outside our reasonable control

To the maximum extent permitted by law, we are not responsible for loss caused solely by matters outside our reasonable control, including failure of third-party internet, videoconferencing or payment infrastructure, except where applicable law provides otherwise.

19.3 Educational decisions

You remain responsible for decisions concerning your examination preparation, registration applications, employment, professional conduct and clinical practice.

The limitations in this clause are subject at all times to the Australian Consumer Law.

20. Disputes and complaints

If you have a complaint concerning the Services, please first contact:

office@img.coach

Please provide sufficient information for us to understand and investigate the issue.

The parties should use reasonable efforts to resolve a dispute in good faith before commencing court proceedings, except where urgent relief is required or a person is exercising a statutory right that cannot lawfully be restricted.

21. Privacy

Personal information is handled in accordance with our Privacy Policy and applicable privacy law.

Acceptance of these Terms does not constitute consent to a use of personal information where separate consent is required by law.

22. Changes to these terms

We may amend these Terms from time to time.

Changes will apply prospectively from the date stated in the updated Terms.

Where a change materially affects an existing paid fixed-term Service, we will not rely on the change to remove an accrued contractual or statutory right without lawful justification.

23. General

23.1 Severability

If a provision is invalid or unenforceable, it will be read down where possible and otherwise severed to the minimum extent necessary without affecting the remaining provisions.

23.2 No waiver

A failure or delay in exercising a right does not constitute a waiver of that right.

23.3 Entire agreement

These Terms, together with the applicable Service description and incorporated policies, constitute the agreement concerning the relevant Service, subject to any rights that cannot lawfully be excluded.

23.4 Governing law

These Terms are governed by the laws of Queensland, Australia, and applicable laws of the Commonwealth of Australia.

Subject to any statutory rights concerning jurisdiction or venue, the parties submit to the courts of Queensland and courts competent to hear appeals from them.
